Terms of Service

Welcome to Custom Racquet Products LLC. By placing an order, submitting a logo, or approving a design, you agree to be bound by the following Terms of Service. These terms are designed to protect both the integrity of your custom products and the operations of our Texas-registered business.

 

1. BINDING AGREEMENT AND EMAIL APPROVALS

In the course of our 10-year history, we have refined a "high-touch" manual approval process. You agree that:

  • Digital Signatures: Any affirmative response via email (e.g., “Approved,” “Looks good,” “Proceed,” “Go for it”) sent to info@customtenniswristbands.com regarding a digital mockup or a physical sample photo constitutes a legally binding digital signature.

  • The Final Point of No Return: Once you provide email approval of the Physical Sample Photo, the order is immediately committed to mass production and international logistics. At this stage, the order cannot be modified, canceled, or refunded.

 

2. CUSTOM GOODS AND REFUND POLICY

All products sold by Custom Racquet Products LLC are custom-manufactured to your specific brand requirements.

  • No Refunds/No Returns: Because these items cannot be resold, we do not offer refunds, returns, or exchanges for "change of mind," subjective dissatisfaction, or errors in your provided logo.

  • Defect Warranty: We stand by our quality. You have seven (7) days from the date of delivery (as marked by the local carrier) to report a manufacturing defect.

  • Defect Resolution: To report a defect, you must email high-resolution photos to info@customtenniswristbands.com. A "defect" is defined as a significant deviation from the approved physical sample photo or the agreed-upon Pantone numbers. If a defect is verified, we will remake the defective portion of your order at our expense. No physical returns are required unless specified by us.

 

3. COLOR MATCHING AND PANTONE STANDARDS

  • The Gold Standard: We use the Pantone Matching System (PMS) to ensure accuracy. If you do not provide a Pantone number, we will select the closest match based on your digital file.

  • Variance: You acknowledge that digital screens display color in RGB/HEX, while wristbands are created with physical dyes. A variance of up to 10% from the digital mockup or the Pantone chip is considered an acceptable industry standard and not a defect.

 

4. INTELLECTUAL PROPERTY AND INDEMNITY

  • Your Assets: You retain all rights to the logos and trademarks you provide.

  • Ownership Warranty: By submitting an order, you warrant that you own the logo or have explicit permission to use it.

  • Indemnity: You agree to indemnify and hold Custom Racquet Products LLC harmless from any and all claims, damages, or legal fees arising from a third-party claim that your provided logo infringes on their trademark or copyright.

 

5. INTERNATIONAL FULFILLMENT AND DDP SHIPPING

  • Origin Disclosure: Our products are designed in the USA and fulfilled through our International Manufacturing Partners.

  • DDP (Delivered Duty Paid): We provide all-inclusive pricing. We are responsible for all international freight, customs clearance, and import duties (including the 2026 Section 122 surcharges).

  • Title and Risk: Risk of loss passes to you once the local carrier (e.g., USPS, FedEx, UPS) provides a "Delivered" scan. We are not responsible for theft ("porch piracy") after a successful delivery scan.

 

6. TIMELINES AND FORCE MAJEURE

  • Standard Lead Time: Our estimated timeline is 5 weeks. This is a good-faith estimate based on 10 years of logistics data but is not a guarantee.

  • Rush Orders: If a "Guaranteed Date" is agreed upon in writing, it is subject to your timely email approvals. Every 24-hour delay in your email response adds 24 hours to the guarantee.

  • Uncontrollable Events: We are not liable for delays caused by customs inspections, international holidays, or global logistics disruptions.

 

7. GOVERNING LAW AND JURISDICTION

Custom Racquet Products LLC is a Texas entity. This agreement is governed by the laws of the State of Texas. You agree that any legal dispute or claim arising from your purchase must be filed and resolved exclusively in the courts of Travis County, Texas.
